Bills introduced

The following Bills were introduced into the Legislative Assembly:

  • Land Valuation Amendment Bill 2023
  • Body Corporate and Community Management and Other Legislation Amendment Bill 2023.

Land Valuation Amendment Bill 2023

On 23 August 2023, the Minister for Resources, the Hon. Scott Stewart MP, introduced the Land Valuation Amendment Bill 2023 into Queensland Parliament.  

The objectives of the Land Valuation Amendment Bill 2023 are to improve the administration and operation of the statutory land valuation framework by amending the Land Valuation Act 2010 to ensure:

  • it is responsive to changes in the property market and operational environment and transparent in its operation;
  • valuations are consistent and defensible, and the supporting processes such as objections and appeals are effective and efficient; and
  • a clear and consistent framework for determining when land is valued separately or combined based on land use and occupation.

A key component of the improvements will allow the valuer-general to make statutory guidelines to provide direction to registered valuers on processes, practices and considerations to be applied in the preparation of statutory land valuations. The need for such guidelines particularly relates to situations where there are complexities associated with the subject land.

Body Corporate and Community Management and Other Legislation Amendment Bill 2023

On 24 August 2023, the Attorney-General and Minister for Justice and Minister for the Prevention of Domestic and Family Violence, the Hon. Yvette D’Ath MP, introduced the Body Corporate and Community Management and Other Legislation Amendment Bill 2023.

The policy objectives of the Bill are to:

  • deliver a key action of the 2022 Queensland Housing Summit by reforming the Body Corporate and Community Management Act 1997 (BCCM Act) to allow for termination of uneconomic community titles schemes to facilitate renewal and redevelopment;
  • deliver a 2020 election commitment to implement amendments to the BCCM Act to allow an adjudicator the power to approve alternative insurance arrangements, and make supporting amendments to complement this change;
  • modernise and improve the operation of the BCCM Act in relation to by-laws and other governance issues, including administrative and procedural matters;
  • strengthen buyer protections under the Land Sales Act 1984 (Land Sales Act) by limiting when sunset clauses can be used to terminate ‘off the plan’ contracts for the sale of land; and
  • make minor amendments to confirm the policy intent of existing provisions of the BCCM Act, Building Units and Group Titles Act 1980 (BUGT Act), Land Sales Act, and the South Bank Corporation Act 1989 (South Bank Act) about the release of deposits paid by buyers under ‘off the plan’ contracts for the sale of land (Land Sales Act) or lots in community titles-style developments (BCCM Act, BUGT Act, and South Bank Act).

The Bill amends the:

  • Body Corporate and Community Management Act 1997
  • Building Units and Group Titles Act 1980
  • Land Sales Act 1984
  • Land Title Act 1994
  • South Bank Corporation Act 1989

The following legislation was passed by the Legislative Assembly:

Child Protection (Offender Reporting and Offender Prohibition Order) and Other Legislation Amendment Bill 2022

On 26 October 2022, the Minister for Police and Corrective Services and Minister for Fire and Emergency Services, the Hon. Mark Ryan MP, introduced the Child Protection (Offender Reporting and Offender Prohibition Order) and Other Legislation Amendment Bill 2022.

The Bill was referred to the Community Support and Services Committee for inquiry.

The Bill was passed with amendment on 24 August 2023.

The main objectives of the Bill are to:

  • ensure the provisions of the Child Protection (Offender Reporting and Offender Prohibition Order) Act 2004 (the Act), which underpin the child protection registry scheme reflect changing offending patterns and behaviours; and
  • enhance the ability for the Act and the Police Powers and Responsibilities Act 2000 (PPRA) to provide for the protection of the lives of children and their sexual safety.

Amendments were moved during consideration in detail of the Bill to achieve its policy objectives.

These include:

  • amendments to clarify and modernise legislation supporting the effective operation of the powers and functions of the Queensland Police Service;
  • decriminalising the offences of public intoxication and begging and introducing new police powers which will enable intoxicated persons to be detained and transported in certain circumstances;
  • amending the offence of public urination; and
  • repealing sex-work specific covert powers afforded to police and ‘move on’ powers targeted at sex workers.
  • amendments to the Youth Justice Act 1992 and the PPRA to clarify the administrative arrangements for holding young people in police washhouses until beds become available in Youth detention centres.

  • Police Powers and Responsibilities Regulation 2012

  • Supreme Court of Queensland Act 1991

Appropriation (Parliament) Bill 2023

The Appropriation (Parliament) Bill 2023 was introduced on 13 June 2023 by the Treasurer and Minister for Trade and Investment, the Hon. Cameron Dick MP.

The Bill provides for:

  • Appropriation for 2023-24 to fund the cost of providing the services, equity adjustment and administered items of the Legislative Assembly and parliamentary service in that year; and
  • Supply for 2024-25 to allow the normal operations of the Legislative Assembly and parliamentary service to continue until the 2024-25 Appropriation (Parliament) Bill receives assent.

The Bill was passed without amendment on 23 August 2023.

Appropriation Bill 2023

The Appropriation Bill 2023 was introduced on 13 June 2023 by the Treasurer and Minister for Trade and Investment, the Hon. Cameron Dick MP.

The Bill provides for:

  • Appropriation for 2023-24 to fund the cost of delivering departmental services, administered items and equity adjustment in that year;
  • Supply for 2024-25 to allow normal operations of government to continue until the 2024-25 Appropriation Bill receives assent; and
  • Appropriation for amounts of unforeseen expenditure approved by the Governor in Council during the 2022-23 financial year including how these amounts are to be reported and lapsed (if required).

The Bill was passed without amendment on 23 August 2023.
