Queensland’s trusts framework will enter a new era later this month when the Trusts Act 2025 (Qld) commences on 28 April 2026.
The new Act will repeal and replace the Trusts Act 1973, updating legislation that has remained largely unchanged for more than 50 years.
The reforms reflect recommendations made by the Queensland Law Reform Commission’s 2013 review.
The legislation aims to simplify and modernise trust law in Queensland, streamlining existing provisions and addressing practical issues under the current Act.
Queensland Law Society has welcomed the start of the long‑awaited reforms, acknowledging the extensive engagement with government in developing the legislation and supporting regulations.
