FWC issues Guidance Note on AI use

The Fair Work Commission (FWC) has issued a Guidance Note on the use of generative AI in Commission cases.

The note, which commences on 20 October 2026, applies to all documents lodged in a case, and outlines how the Commission itself may use AI.

In a statement yesterday, FWC President Justice Adam Hatcher said the Commission’s workload had increased by more than 70 per cent in three years.

Justice Hatcher said this was not explained by any developments in the labour market and had coincided with the introduction and popularisation of generative AI tools and the widespread appearance of AI-generated language in applications and other documents lodged in the Commission.

He said the note was the result of research into AI use and consultation with stakeholders.
