Get ready for new seller disclosure

New seller disclosure requirements are going to become a mandatory part of Queensland property transactions from 1 August 2025.

An important part of the disclosure requirements means that sellers must provide buyers with a Seller Disclosure Statement before the buyer signs the contract.

The disclosure requirements are mandatory, and sellers and buyers cannot contract out of them.

This statement must be accurate and complete and include the relevant prescribed certificates.

Failure to comply with these disclosure requirements can give buyers the right to terminate the contract before settlement.

Leveraging new tools to support disclosure and compliance

To assist legal professionals and their clients in navigating the new regulations, Lotsearch has created two specialised reports to assist sellers in answering the required questions under ‘Part 3 – Land use, planning and environment’ of the Seller Disclosure Statement.

Seller Disclosure – Zoning

The ‘Lotsearch Seller Disclosure – Zoning report’ supports clients in meeting their legal disclosure obligations under the new QLD Seller Disclosure framework.

Manually sourcing zoning information can be time-consuming and complex.

The Zoning report provides a streamlined solution – supporting compliance, reducing the risk of omissions, and presenting relevant zoning information in a single, easy-to-use document.

The zoning report aggregates information from six planning instruments.

Seller Disclosure – Contamination Notices

The Seller Disclosure – Contamination Notices report specifically targets the contamination and environmental protection disclosure requirements.

This includes searches of relevant notices and orders under sections 347(2), 369C(2), and 408(2) of the Environmental Protection Act 1994. The report searches public registers and presents records of environmental notices or orders relevant to the property.

The Contamination Notices report provides a streamlined solution – supporting compliance, reducing the risk of omissions, and helping legal practitioners and their clients to answer the following questions in a single, easy-to-use document.

Key take-away

Lotsearch has developed two new searches that help clients to meet the new seller disclosure requirements.

These searches will help lawyers avoid errors or omissions that could give buyers the right to terminate the contract.
