QLRC delivers criminal defences report

The Queensland Law Reform Commission has delivered its final report and recommendations as part of its criminal defences review to the Attorney-General.

The report reflects engagement with judicial, legal and community stakeholders, including the Queensland Law Society.

The report is yet to be tabled in Parliament. Once tabled, review findings and recommendations will be made public.

On 15 November 2023, the Queensland Government asked QLRC to examine and make recommendations about particular defences in the Criminal Code:

  • self-defence;
  • provocation as a defence to assault;
  • provocation as a partial defence to murder;
  • the partial defence to murder of killing for preservation in an abusive domestic relationship, and;
  • domestic discipline.

Consultation meetings were held in Cairns, Yarrabah, Townsville, Toowoomba, Ipswich, Beenleigh, the Gold and Sunshine Coasts, Mt Isa, Cloncurry and Central Queensland.

On 20 February 2025, the QLRC released its consultation paper which included questions for consultation and asked for submissions.
