The Queensland Civil and Administrative Tribunal (QCAT) has introduced five forms for disputes under the Manufactured Homes (Residential Parks) Act 2003 (Qld) and Retirement Villages Act 1999 (Qld) to streamline the application process in both jurisdictions.
These forms are:
- Form 64A – Application for referral to mediation (Manufactured Homes (Residential Parks) Act 2003)
- Form 64B – Application for referral to mediation (Retirement Villages Act 1999)
- Form 30A – Application for a tribunal hearing (Manufactured Homes (Residential Parks) Act 2003)
- Form 30B – Application for tribunal hearing – general (Retirement Villages Act 1999)
- Form 30C – Application for a tribunal hearing – homeowners committee (Manufactured Homes (Residential Parks) Act 2003)
As a result, the following forms are revoked and will no longer be used:
- Form 3 – Dispute notice for referral to mediation (Retirement Villages Act 1999)
- Form 31 Application for a tribunal hearing (Retirement Villages Act 1999)
The five new forms will:
- enable parties to easily make an application under the two Acts and identify the issues in dispute;
- capture relevant applicant/respondent details, including whether they are a home owner, park owner, group representative, village resident, retirement village scheme operator, or home owners’ committee;
- easily identify the name and address of the relevant residential park or retirement village;
- specify whether mediation was attempted or if the matter is exempt from mediation;
- identify lead applicant details and responsibilities;
- capture group applicant details where a group representative has been authorised to represent the applicants in a proceeding; and
- capture representative details (where relevant).
