High Court upholds WA border closure laws

The High Court of Australia this morning upheld the constitutional validity of Western Australia’s quarantine border closure laws in the case brought by Clive Palmer.

The court found that the border closure laws complied with the constitutional limitation in s92 of the Constitution, given their “application to an emergency constituted by the occurrence of a hazard in the nature of a plague or epidemic”. Detailed reasons for judgement are to be published at a date to be fixed.
