QCAT updates discipline applications PD

Queensland and Civil Administrative Tribunal President Justice Kerri Mellifont has issued Practice Direction No.10 of 2021 – Directions relating to discipline applications and requests for compensation under the Legal Profession Act 2007.

The practice direction streamlines the processes for progressing legal profession matters at QCAT and replaces QCAT Practice Direction No.2 of 2010.

In summary, it outlines:

  • procedural requirements for disciplinary applications made under the Legal Profession Act 2007
  • pre-hearing filing requirements by the parties, including the requirement to file an electronic hearing brief prior to the hearing
  • requirements for where a person seeks a compensation order including needing to prepare, file and serve a QCAT Notice of Intention to Seek Compensation Order form.
