New QCAT PD: Review of QBCC decisions

Queensland Civil and Administrative Tribunal President Justice Kerri Mellifont today issued QCAT Practice Direction No.9 of 2022 – Applications for review of decisions made by the Queensland Building and Construction Commission.

The practice direction explains the pre-hearing process, including:

• providing information to assist the understanding of the process by the litigants;
• promote matters being dealt with in a more efficient way, while retaining fairness and justice;
• ensuring all necessary interlocutory applications, for example, joinder or extension of time applications, are filed and dealt with, early in the proceedings;
• facilitate the hearing by the provision of a Hearing Book containing all relevant material upon which each party intends to rely.
