The Acts Interpretation (Fee Unit) Amendment Regulation 2023 was made on 11 May 2023 by the Governor in Council
AIA Regulation amendment
The regulation amends the Acts Interpretation (Fee Unit) Regulation 2022 (AIA Regulation) to index all fees displayed as a fee unit for the 2023-24 financial year. The AIA regulation has been amended to prescribe the value/s of the fee unit (inclusive of indexation for 2023-24) from 1 July 2023 as $1.060.
Publication requirements
Agencies are reminded that they are required to publish their schedule of fees in dollar amounts, in a way that ensures they are easily accessible by all members of the community, for example, agency website, informational brochures, automated phone system etc.
The schedule of fees must include reference to the date fees were last indexed and by what rate/percentage (i.e. the Government Indexation Rate for the relevant period, being 3.4% for 2023-24). Where the schedule of fees includes fees and charges with varying indexation dates, this must be noted and accounted for. If the schedule of fees includes fees that do not use the Government Indexation Rate this must also be noted. Example disclosures are provided for in the Principles for Fees and Charges – ‘Publication of Agency Fees’ (see Section 4.3.4).
For example: “Our fees and charges increase on 1 July each year. On 1 July 2023 our fees and charges were increased by 3.4% in line with Government’s indexation policy. You can contact us to find out details about specific fees, charges or prices.”
The Right to Information access application fee and processing charge will increase from 1 July 2023 as follows:
New application fee: $55.75
New processing charge: $8.65/15 minutes
There has been no change made to the copying charge.
