NEW: Direct debit guidelines for the Titles Registry of the Department of Resources

Queensland Law Society has approved an application from the Titles Registry of the Department of Resources, to authorise all Queensland law practices to make payments to the Department of Resources by direct debit authority payments from law practice trust accounts.

The web-based electronic lodgement portal for Titles Registry documents provides a secure platform by which direct debit payments of lodgement fees can be made.

The Society has prepared a set of guidelines for trust account operations – Direct Debit Authority Titles Registry of Department of Resources. The guidelines outlines the legislative requirements and best practice principles for the making, approval and recording of the direct debit payments to the Department of Resources.

Section 250(1) of the Legal Profession Act 2007 states that a Queensland law practice cannot disburse money from a trust account by electronic funds transfer (EFT) without being authorised by the Society to do so. Direct debit authority payments are a form of electronic funds transfer. Any law practice in Queensland that operates a trust account that wishes to make direct debit payments to the Department of Resources must make application and be approved by the Society to do so.
