The three-month grace period for filing old Family Court of Australia and Federal Circuit Court of Australia forms, following the commencement of the Federal Circuit and Family Court of Australia (FCFCOA) on 1 September 2021, is about to end.
From Monday 29 November 2021, only the new, approved FCFCOA versions of court forms can be filed.
Work has continued on refining the new forms since they were first published, including minor amendments and corrections.
Since the last update on 8 November 2021, the following forms have been amended:
- Affidavit – non-filing of family dispute resolution certificate – form approval note updated to rule 4.02(1)(b) rather than 15.21 of the Federal Circuit and Family Court of Australia (Family Law) Rules 2021.
- Undertaking as to disclosure – part B point 1 updated to include the full name of the rules – Federal Circuit and Family Court of Australia (Family Law) Rules 2021.
All court forms are available from the fcfcoa.gov.au website:
The court recommends accessing forms directly from the website, to ensure the most up-to-date version is used.
Practitioners or precedent holders who need to access an unlocked court form, should email a request to communication@fcfcoa.gov.au.
