Lawyer has costs order set aside

A lawyer who was ordered to pay costs after being found to have engaged in unsatisfactory professional conduct has had that order set aside on appeal.

In the Queensland Civil and Administrative Tribunal in April, Brisbane lawyer Vincent Pennisi was fined $5000 and a public reprimand was ordered in relation to him unduly delaying the finalisation of an estate for about six years.

Mr Pennisi was also ordered to pay the costs of the proceedings, an order he appealed in September.

On Friday, the Supreme Court allowed the appeal, set aside the costs order, and substituted a different costs order based on Mr Pennisi’s success against one charge by the Legal Services Commissioner, and his loss on the other.
