QCAT body corp forms updated

Queensland Civil and Administrative Tribunal (QCAT) has updated Form 28 – Application to resolve a complex dispute (excluding lot entitlement disputes) – Body Corporate and Community Management Act 1997 and Form 29 – Application for the adjustment of a lot of entitlement schedule – Body Corporate and Community Management Act 1997.

The Form 28 has been updated to:

  • Remove the tick box options for both a stay of the contract and for injunction relief/interim order in Part D.
  • Include additional instructions that if an applicant wishes to apply for an interim order /interim injunctive relief, they will need to complete a separate Form 41– Application for Interim Order/

Form 41 will be updated in the future to clarify it can be used for applications for interim injunctions.

Forms 28 and 29 have been updated to:

  • Include amendments in line with current branding and content requirements for QCAT forms to ensure consistency with other QCAT forms.

Please note Form 28 and Form 29 are now available on the QCAT website.
