Queensland Civil and Administrative Tribunal (QCAT) has updated Form 28 – Application to resolve a complex dispute (excluding lot entitlement disputes) – Body Corporate and Community Management Act 1997 and Form 29 – Application for the adjustment of a lot of entitlement schedule – Body Corporate and Community Management Act 1997.
The Form 28 has been updated to:
- Remove the tick box options for both a stay of the contract and for injunction relief/interim order in Part D.
- Include additional instructions that if an applicant wishes to apply for an interim order /interim injunctive relief, they will need to complete a separate Form 41– Application for Interim Order/
Form 41 will be updated in the future to clarify it can be used for applications for interim injunctions.
Forms 28 and 29 have been updated to:
- Include amendments in line with current branding and content requirements for QCAT forms to ensure consistency with other QCAT forms.
