Administrative review body seeks input

The re-established Administrative Review Council (ARC) is seeking input from practitioners to help it monitor the integrity and operation of the Commonwealth administrative law system.

The independent advisory body was reinstated during reforms of the country’s administrative systems, which included the replacement of the Administrative Appeals Tribunal with the Administrative Review Tribunal (ART) last year.

Since it began in January this year, the ARC has resolved to undertake separate inquiries into the social security and migration provisions enacted at the time of the establishment of the ART, which affect its procedure in these jurisdictional areas.

Terms of reference for these inquiries and information about consultation processes will be available soon.

The ARC’s Best Practice Guide: Statements of Reasons, replacing the 2007 guide on this topic, and reflecting changes in case law and relevant legislation, is due this month.

The council plans to develop a new Best Practice Guide: Improving the Quality of Administrative Decision-making.

There will be opportunities for stakeholders to contribute through public consultation, and they are encouraged to visit the ARC website for information.
