IP Australia has released a factsheet providing expanded guidance on on extensions of time to submit evidence in trade mark opposition matters.
The factsheet covers the grounds on which an extension of time to file evidence may be sought in an Opposition matter, practical guidance on substantiation of those grounds when submitting an Extension Request, and common scenarios where an Extension Request is likely to be successful.
The factsheet is intended to supplement Part 51.2 of the Trade Marks Manual of Practice and Procedure and should also be read in conjunction with the relevant provisions of the Trade Marks Act 1995 (Cth) and Trade Marks Regulations 1995 (Cth).
